GIVING THE BASICS, INC.
The following Privacy Policy (“Privacy Policy”) discloses the privacy practices of GIVING THE BASICS, Inc., a Kansas NOT-FOR-PROFIT corporation (“GTB”, “us”, “we” or “our”) for the GTB website located at www.givingthebasics.com (the “Website”) and all of the content AND services offered from time to time by, on or through the Website (collectively the Website and all of its content and services offered from time to time are referred to herein as the “Services”). GTB created this Privacy Policy in order to communicate its privacy policies to each USER OF THE WEBSITE, including each donor and charity (AS THESE TERMS ARE DEFINED IN GTB’S TERMS OF USE POSTED ON THE WEBSITE). In addition to complying with this Privacy Policy and the Terms of Use, you agree to comply with any and all applicable laws with respect to your use of the Services.
By using the Services, each Donor and Charity is deemed to consent to our privacy practices set forth in the Privacy Policy as amended from time to time. If you do not consent to these privacy practices, do not use the Services or access any content on the Website. GTB may amend this Privacy Policy from time to time and will inform you and other Donors and Charities by posting the changed Privacy Policy to the Website. The amendments will be effective immediately upon posting the changes to this Website. By using any of the Services after any amendment is posted to the Website, you agree to be bound by the amendments. You should review the Privacy Policy from time to time to ensure that your use is in compliance and you agree to the terms. IF YOU DO NOT AGREE TO ANY AMENDMENT TO THIS PRIVACY POLICY, YOU SHOULD IMMEDIATELY CEASE USE OF THE SERVICES AND TERMINATE YOUR REGISTRATION WITH GTB.
1. Types of Information Collected
a. Traffic Data. We may track and collect the following general and non-personal information when you visit our Website including your: (i) IP address; (ii) origin of the search that led you to the Website (i.e. how you got to the Website – was it by a Google® search, by direct navigation, etc.); (iii) connection speed; and (iv) type of web browser (collectively, “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Website. We use Traffic Data to collect information at an aggregate level about the visiting and use of the Website and to make the use of the Services more enjoyable to our users.
b. Information Collected from Donors. In order for each Donor to make a donation to GTB through the Website, such Donor is required to provide various information to GTB, including personal identifying information (collectively, “Donor Information”). If a Donor communicates with GTB by e-mail or otherwise completes an online form, any information provided in such communication will be collected by GTB as Donor Information.
Donor Information may consist of the following types of information:
Contact Data. Contact Data includes your name, mailing address, telephone number, and e-mail address. We use Contact Data to send Donors information about our company and its Services or in response to a donation to GTB or use of any other Services on the Website by Donors. As a Donor, you consent to receive communications from GTB electronically, but have the ability to opt-out of receiving future emails about our company and other Services. To be removed from receiving any mailings, you may contact GTB at the Contact page. GTB will communicate with each Donor by e-mail or posting notices on the Website. As a Donor, you agree that all communications, disclosures and notices sent to you by e-mail shall satisfy any requirement that notice be provided in writing.
Donor Password. Each Donor may create an account with GTB by selecting a password. The password, when submitted through the Website in combination with your e-mail address, will give you access to your account.
Financial Information for Monetary Donations. To make a donation of money to GTB through the Website, you may submit your donation through the payment system administered by Authorize.net or by authorizing a payment through your PayPal account. We do not retain or store your credit card or bank account information.
c. Information Collected from Charities. In order for a Charity to apply to GTB to become a registered charitable organization and request a distribution of products from GTB, such Charity is required to provide GTB certain identifying and supporting information (collectively, “Charity Information”). If a Charity communicates with GTB by e-mail or otherwise completes online forms, any information provided in such communication will be collected by GTB as Charity Information.
Charity Information may consist of the following types of information:
Contact Data. Contact Data includes the name, mailing address, telephone number, e-mail address, and website of the Charity, as well as the name of a contact person for the Charity and other profile information about the Charity. We use Contact Data to determine whether a Charity is eligible to be a registered Charity of GTB, and to send information about our company and Services, or in response to a Charity’s application for registration, request for donation or use of any other Services on the Website by a Charity. As a Charity, you consent to receive communications from GTB electronically, but have the ability to opt-out of receiving future emails about our company and other Services. To be removed from receiving any mailings, you may contact GTB at the Contact page. GTB will communicate with each Charity by e-mail or posting notices on the Website. As a Charity, you agree that all communications, disclosures and notices sent to you by e-mail shall satisfy any requirement that notice be provided in writing.
Charity Requests. We will collect information about your organization’s program(s) that distribute products to individuals in need and the types of products you distribute through such program(s). We will also collect information about your facilities to which we may deliver donated products (e.g., whether your facility has a loading dock and the location of the dock).
d. Use of Cookies and Web Beacons. GTB requires the use of cookies. Cookies are small text files a website can use to recognize a repeat visitor to the website. We use cookies for various reasons. Cookies enable us to provide you with a better experience by allowing us to understand what areas of this Website are of interest to our Donors and Charities. These cookies do not track personal information. Cookies from GTB can only be read by GTB and the Website. If you do not want GTB to deploy cookies in your browser, you can set your browser to reject cookies or to notify you when a website tries to put a cookie in your browser software. If you choose to disable cookies in your browser, you can still access most of this Website; however, your ability to use some of this Website may be affected.
2. Accounts and Passwords
If you register as a Donor, you will be required to provide a password. Providing a password will allow you to create a Donor account, which you can access with your email address and password. If you register as a Charity, we will assign you an account number, which you will be required to use with your email address to access your Charity account. You are responsible for maintaining the confidentiality of your password or account number. You shall be responsible for all uses of your account, password, and account number, including, without limitation, any charges to credit card, bank account, or your PayPal account, whether or not authorized by you. You agree to immediately notify us of any unauthorized use of your account. In such an event, if you are a Donor you will need to provide us a new password, and if you are a Charity we will assign you a new account number. You may access or correct your account information that we maintain by logging into the Website or contacting GTB through the Contact page. To better protect your privacy and security, your email address must match the email address used to establish your account. We use this procedure to better safeguard your information.
3. Confidentiality and Security of Donor Information and Charity Information
Except as otherwise provided in this Privacy Policy (including Section 4 below related to use of third parties to provide you the Services), we will keep all of your information that personally identifies you (e.g., your Contact Data) as private and will not share it with third parties, unless such disclosure is necessary to: (i) comply with a law or based upon the good faith belief that disclosure is necessary to comply with a law; (ii) protect our rights or property; (iii) enforce our Terms of Use, this Privacy Policy, or any of our policies and guidelines; or (iv) when specifically authorized by you. GTB will use a variety of commercially reasonable security technologies to help protect your personally identifying information from unauthorized access, use or disclosure. However, the use of such security technologies by GTB is not, and shall not be considered to be, any type of guarantee or warranty by GTB that the personally identifying information of users of this Website will not be accessed by third parties, or that GTB will use all available security technologies to prevent unauthorized access to, use or disclosure of your personally identifying information. We provide you with the capability to transmit your personal and financial information for the purpose of making donations to GTB via secured and encrypted channels if you use a similarly equipped web browser.
4. Limited Sharing of Information
We share your Donor Information and Charity Information (i) with third parties assisting GTB in its provision, administration, and management of the Services; (ii) with third parties that assist GTB in providing the Services you request; (iii) with third parties that assist GTB with the screening of Charities that apply to be a registered Charity with GTB; and (iv) as otherwise permitted by law from time to time. While GTB uses commercially reasonable efforts to safeguard your Donor Information and Charity Information transmitted to third parties, GTB does not warrant that your Donor Information or Charity Information will be transported without unauthorized interception or modification or that your Donor Information or Charity Information will not be accessed or compromised by unauthorized third parties.

The Website may contain links to other websites. We are not responsible for the privacy practices or the content of such websites.
6. Updates and Changes to Privacy Policy
We reserve the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, simply by posting such change, update or modification on the Website. Any such change, update or modification will be effective immediately upon posting on the Website.
7. Eligibility; Compliance with Children Privacy Issues
GTB takes compliance with children online privacy laws seriously. By using and/or visiting the Website, you are representing and warranting to GTB that you are: (a) 18 years of age or older; and (b) fully able and competent to enter into and abide by this Privacy Policy.
Notwithstanding the previous paragraph, you affirm that you are over the age of 13. IF YOU ARE UNDER THE AGE OF 13, DO NOT USE GTB’S SERVICES AND/OR VISIT THE WEBSITE. GTB does not knowingly collect or maintain personally identifiable information from children under the age of 13. If you know of someone using this Website who is under the age of 13, please notify us immediately. If GTB is informed that anyone under the age of 13 is using the Website, his or her account and password will be cancelled and all of his or her information will be deleted from the Website as soon as practical.
